INFORMATION WE PROCESS

You should understand that information you provide, have provided and may provide in future will be processed by us, in compliance with UK data protection laws for the purpose of providing insurance, handling claims and/or responding to complaints.

INFORMATION CONTAINING PERSONAL AND SPECIAL CATEGORY DATA

Information we process may be defined as personal and/ or sensitive personal information. Personal data is information that can be used to identify a living individual e.g. name, address, driving licence or national insurance number. Personal data is also information that can identify an individual through a work function or their title.

In addition, personal data may include special category data, such as information about Your health. We may also process information relating to criminal convictions where permitted by law.

We will not use personal data and/or special category data except for the specific purpose for which You provide it and to carry out the services set out within this notice.

We may pass your personal data and/or special category data to industry-related third parties, including authorised agents; service providers; capacity providers; reinsurers; other insurers; legal advisers; loss adjusters and claims handlers.

We may also share your personal data with law enforcement, fraud detection, credit reference and debt collection agencies and within our group of companies to:

  1. assess financial and insurance risks;
  2. recover debt;
  3. to prevent and detect crime; and/or
  4. develop products and services.

We will not disclose Your personal data outside our group of companies except:

  1. where we have your permission;
  2. where we are required or permitted to do so by law;
  3. to other companies who provide a service to us or you; and/or
  4. where we may transfer rights and obligations under the insurance.

WHY IS IT NECESSARY TO SHARE INFORMATION?

Insurance companies share claims data to:

  1. ensure that more than one claim cannot be made for the same personal injury or property damage;
  2. check that claims information matches what was provided
  3. when the insurance was taken out;
  4. act as a basis for investigating claims when We suspect that fraud is being attempted; and/or
  5. respond to requests for information from law enforcement agencies.

THE TRANSFERRING OF INFORMATION OUTSIDE THE EUROPEAN ECONOMIC AREA

In providing insurance services, we may transfer your personal and/or sensitive personal information to other countries including countries outside the European Economic Area. If this happens We will ensure that appropriate measures are taken to safeguard Your personal and/or sensitive personal information.

ACCESS TO YOUR INFORMATION

You have a right to know what personal data We hold about you. If you would like to know what information we hold, please contact the Data Protection Officer at the address listed within this notice, stating the reason for your enquiry. We may write back requesting You to confirm Your identity.

If We do hold information about you, we will:

  1. give you a description of it;
  2. tell you why we are holding it;
  3. tell you who it could be disclosed to; and
  4. let you have a copy of the information in an intelligible form.

You also have the right to:

  1. be informed about how your personal data is used;
  2. request correction of inaccurate data;
  3. request deletion of your data in certain circumstances;

  4. where required, for special category data, under conditions permitted by law (e.g. insurance purposes).

HOW LONG WE KEEP YOUR INFORMATION

We retain your personal data only for as long as necessary for the purposes set out in this notice, including to meet legal, regulatory, tax and insurance requirements. Retention periods may vary depending on the type of data and purpose.

AUTOMATED DECISION-MAKING

We may use automated decision-making and profiling in relation to underwriting, pricing and fraud prevention. Where this occurs, it is subject to appropriate safeguards.

COMPLAINTS

We will acknowledge your complaint promptly, typically within 5 working days, and aim to respond within a reasonable timeframe, typically within one month. Where a full response cannot be provided within this timeframe, we will keep you informed of progress and the reasons for the delay.

We maintain records of complaints and how they are handled in accordance with our legal obligations.
